What makes legal marijuana different from all that 420 stuff with the bad reputation? Regulations, of course. Legal cannabis flowers and products have to come in packaging with specific safety features, including childproof and tamper-evident packaging. In addition to laws about how legal cannabis products are packaged, there are also very strict regulations about the labels that go on that specialized cannabis packaging. It gets even more complicated. The number of states legalizing cannabis for recreational or medicinal purposes is only growing, and each one has different laws about how it’s sold and packaged.

Who is regulated by legal marijuana laws?

Growers
Growers

That old baggie is a thing of the past and legal cannabis flowers or buds can only be sold in childproof packaging that’s labeled with weight, quantity, cannabis strain, potency and other product information. Whether selling a mature plant or a concentrate it will require packaging. Many states require growers to label all their plants with the strain and place of origin as it’s important in a legal market to convey to the consumer what exactly they are purchasing.

Edibles Producers

When it comes to cannabis edibles they have very stringent packaging and labeling requirement (varies by state), including disclosing detailed dosing information and is best practice to abide by all FDA nutritional guidelines as edibles are ingested.

Retailers
Retailers

Medical or recreational marijuana dispensaries are subject to a host of compliance and regulation laws on the operational side  before they even consider the sale of cannabis product. In many states, the laws dictate not only how the retail establishments store and display product, but also for how customers leave the store with their items as well. Opaque exit packaging with child resistant safety features is required in many states at the point of sale.

Processors
Processors

If the business is in the cultivation and/or processing sector of the cannabis industry there a number of states (including the large west coast marketing) that are now passing the burden of responsibility to portion and compliantly packaging at the source. Each state has varying degrees of stringent requirements that that processors will need to make themselves aware.
